Miami-Dade County Wins Court Appeal

On December 23, 2020, the Third District Court of Appeals approved the County’s Coconut Grove Playhouse appeal. The Court agreed with the County’s argument that the City of Miami Mayor Francis Suarez’s veto of the County’s historic preservation certificate of appropriateness was a quasi-judicial act and that therefore the lower court wrongly found that it lacked jurisdiction to hear the case on the merits. You can see the Court’s decision here. The decision remands the case to the lower court for further proceedings and for a decision on the merits as to the County’s challenge of the mayoral veto.
